MacAgent — Remote Desktop Streaming Application

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and MacMonitor ("Developer," "we," "us," or "our") governing your use of the MacAgent application ("Application" or "App") available on the Apple App Store. By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.
1. Age Requirements and Suitability
1.1 Age Rating
This Application has been rated 4+ (Ages 4 and Up), meaning it contains no objectionable material and is suitable for users of all ages. This rating applies across all countries and regions where the Application is available on the Apple App Store. An equivalent age suitability rating will be calculated and displayed for each country or region based on their respective age classification standards and guidelines.
1.2 Parental and Guardian Responsibility
While this Application is rated suitable for all ages, it is a remote desktop streaming utility that allows users to view and interact with a Mac computer remotely. Parents and guardians are encouraged to supervise minors when using this Application. The Developer does not assume responsibility for the content displayed on the remote Mac desktop that may be streamed through the Application. The content visible during a streaming session is entirely determined by what is present on the user's Mac computer at the time of use.
1.3 No Objectionable Content
The Application itself does not contain, display, generate, or distribute any content that could be considered objectionable, inappropriate, or harmful. The Application does not include violence, sexual content, profanity, gambling, horror or fear themes, alcohol, tobacco or drug references, simulated gambling, mature or suggestive themes, or any other form of restricted content. The Application is a utility tool designed solely for the purpose of streaming a Mac desktop to an iOS device.
2. License Grant
2.1 Scope of License
Subject to the terms of this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service and the Usage Rules set forth in the Apple Media Services Terms and Conditions.
2.2 Restrictions
You shall not: (a) copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Application; (b) distribute, sublicense, lease, rent, loan, or otherwise transfer the Application to any third party; (c) make the functionality of the Application available to multiple users through any means, including but not limited to uploading the Application to a network or file-sharing service; (d) use the Application for any unlawful purpose or in violation of any applicable local, state, national, or international law; (e) use the Application to monitor, record, or stream the screen of any computer without the knowledge and consent of the computer's owner or authorized user; (f) remove, alter, or obscure any proprietary notices, labels, or marks on the Application.
2.3 Reservation of Rights
All rights not expressly granted to you in this Agreement are reserved by the Developer. The Developer retains all right, title, and interest in and to the Application, including all intellectual property rights therein.
3. Subscription Terms
3.1 Free Preview
The companion MacMonitor iOS application provides a free preview of the streaming functionality, limited to two (2) minutes per session. During the free preview period, all features of the Application are available without restriction. After the free preview period expires, the streaming session will be disconnected and the user will be prompted to subscribe for continued access.
3.2 Monthly Subscription
Unlimited streaming access is available through a monthly auto-renewable subscription priced at $4.99 USD per month (or equivalent pricing in your local currency as determined by the Apple App Store). The subscription grants unlimited streaming time per session with no restrictions on the number of sessions.
3.3 Auto-Renewal
Your subscription will automatically renew at the end of each monthly billing period unless you cancel it at least twenty-four (24) hours before the end of the current billing period. Your Apple ID account will be charged for renewal within twenty-four (24) hours prior to the end of the current period at the same subscription price. You can manage and cancel your subscription by going to your Account Settings on the App Store after purchase.
3.4 Cancellation
You may cancel your subscription at any time through your Apple ID Account Settings. Upon cancellation, your subscription will remain active until the end of the current billing period, after which it will not renew. No refunds will be provided for any unused portion of a subscription period. After your subscription expires, the Application will revert to the free preview mode with a two-minute session limit.
3.5 Price Changes
The Developer reserves the right to change the subscription price at any time. If the price increases, you will be notified in advance and given the opportunity to cancel before the new price takes effect. Any price changes will take effect at the start of the next subscription period following the date of the price change.
4. Privacy and Data Collection
4.1 Screen Content
The Application facilitates real-time streaming of your Mac desktop to your iOS device. The Developer does not access, collect, store, or transmit any of the screen content that is streamed between your devices. All streaming data is transmitted directly between your devices either over your local network or through an encrypted relay server.
4.2 End-to-End Encryption
When streaming over the internet via the relay server, all video frames and input events are encrypted end-to-end using AES-256-GCM encryption. The relay server cannot decrypt or view the content of your streaming sessions. When streaming over a local network, data is transmitted without encryption as the local network is considered a trusted environment.
4.3 Device Information
The Application uses Apple's CloudKit service to register your Mac device for remote discovery. This includes basic device information such as the device name and network identifiers necessary for establishing connections. This information is stored in Apple's iCloud infrastructure and is subject to Apple's privacy policy.
4.4 No Personal Data Collection
The Developer does not collect, store, or process any personal information, usage analytics, crash reports, or telemetry data through the Application. The Application does not contain any third-party analytics frameworks, advertising SDKs, or tracking technologies.
5. Permissions and System Access
5.1 Screen Recording Permission
The Application requires macOS Screen Recording permission to capture and stream your desktop. This permission must be explicitly granted by the user through macOS System Settings. The Application cannot capture your screen without this permission being enabled.
5.2 Accessibility Permission
The Application requires macOS Accessibility permission to process remote keyboard and mouse input received from the companion iOS application. This permission must be explicitly granted by the user through macOS System Settings. The Application cannot process remote input without this permission being enabled.
5.3 Network Access
The Application requires network access to advertise its presence on the local network via Bonjour, accept incoming streaming connections from the companion iOS application, and optionally connect to the relay server for remote streaming. The Application listens for incoming TCP connections on the local network and may establish outgoing WebSocket connections to the relay server.
5.4 User Responsibility
You are solely responsible for ensuring that you have proper authorization to use the Application on any computer where it is installed. You acknowledge that screen recording and remote access capabilities should only be used on computers that you own or have explicit permission to monitor. Unauthorized monitoring of another person's computer may violate local, state, or federal laws.
6. Disclaimer of Warranties
The Application is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. The Developer does not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components. The Developer does not warrant that the results obtained from the use of the Application will be accurate or reliable. The entire risk arising out of the use or performance of the Application remains with you.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use the Application, regardless of whether such damages are based on warranty, contract, tort, statute, or any other legal theory, and regardless of whether the Developer has been advised of the possibility of such damages. In no event shall the Developer's total liability to you for all damages exceed the amount you paid for the Application in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Developer and its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Application; (b) your violation of this Agreement; (c) your violation of any rights of any third party; or (d) your use of the Application to monitor any computer without proper authorization.
9. Termination
9.1 Termination by User
You may terminate this Agreement at any time by deleting the Application from all of your devices and ceasing all use of the Application.
9.2 Termination by Developer
The Developer may terminate this Agreement at any time, with or without cause, by providing notice to you or by disabling your access to the Application. Upon termination, all rights granted to you under this Agreement will immediately cease.
9.3 Effect of Termination
Upon termination of this Agreement, you must immediately cease all use of the Application and delete all copies of the Application from your devices. Sections 6, 7, 8, and 10 shall survive any termination of this Agreement.
10. General Provisions
10.1 Entire Agreement
This Agreement constitutes the entire agreement between you and the Developer with respect to the Application and supersedes all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and the Developer regarding the Application.
10.2 Severability
If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.
10.3 Waiver
The failure of the Developer to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by the Developer.
10.4 Assignment
You may not assign or transfer this Agreement or any rights or obligations hereunder, in whole or in part, without the prior written consent of the Developer. The Developer may assign this Agreement without restriction.
10.5 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is located, without regard to its conflict of law provisions.
10.6 Apple App Store Terms
This Agreement is supplemental to and does not supersede the Apple Licensed Application End User License Agreement (the "Standard EULA") available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of any conflict between this Agreement and the Standard EULA, the Standard EULA shall prevail to the extent of the conflict.
